These Terms of Service govern your use of the Budster Harvest website and your purchase of harvest goods from Budster Farm LLC at our yard in Logan, Utah. They form an agreement between you and Budster Farm LLC, 980 W 1000 S, Logan - 84321-5415, United States (US). Please read them fully before reserving a produce box, a season share, an egg flat, a sack of stone-milled flour, a greenhouse start, or before joining a farm gate market day.

1. Acceptance of These Terms

By browsing the Budster Harvest website, sending a message through our contact form, reserving harvest goods, or entering the farm gate at 980 W 1000 S, Logan - 84321-5415, United States (US), you agree to be bound by these Terms of Service. If you do not agree with any part of them, please do not use our website or purchase from our farm stand.

These terms apply to every visitor, customer and member of a season share. They also apply to anyone who acts on behalf of a customer, such as a family member collecting a reserved box. When you place an order for someone else, you confirm that you are allowed to share that person details with us and that they accept these terms.

We may update these terms over time as described in the changes section below. The version published on this page is the current version and replaces any earlier version.

2. The Harvest Goods We Provide

Budster Farm LLC grows, gathers, mills and packs six kinds of harvest goods at its Logan, Utah farm stand: Seasonal Produce Boxes, Sweet Corn and Melon Share, Free-Range Eggs and Dairy Goods, Stone-Milled Grains and Flours, Greenhouse Starts and Seedlings, and Farm Gate Market Days. These terms cover all six, whether you reserve them in advance or buy them at the gate.

We describe each good on the harvest goods page, including what it typically contains and how it is handled. Descriptions are provided in good faith so you know what to expect, but they are not a guarantee of a specific variety, weight or count in any single week.

We provide harvest goods as a family farm, not as a grocery chain. That means our supply follows the weather, the season and the soil. Where a good cannot be provided as described, we will offer a reasonable substitute or a refund as set out in these terms.

3. Eligibility and Account-Free Use

You must be able to form a binding agreement to reserve harvest goods or join a season share. If you are under the age required for independent consent in your jurisdiction, you may use our services only with the involvement of a parent or guardian.

Our website does not require you to create an account. We collect only the details we need to answer your message or prepare your order. This keeps the farm stand simple and keeps your information close to the work that created it.

You agree to provide accurate contact details so we can confirm your order and reach you if a harvest changes. If details change, please tell us so a reserved box is not held for the wrong person.

4. Orders and Reservations

You may reserve harvest goods by calling +15679077443, by email at reception@budsterharvest.lat, or by speaking with our crew at the farm gate. A reservation becomes an order when we confirm it and, where a deposit is required, when the deposit is received.

Because our goods are seasonal and perishable, quantities are limited. We fill orders in the order we receive them and we may decline or limit a request when the fields cannot supply it. If we cannot fill your order, we will tell you promptly and offer the closest available alternative.

We may set reasonable limits on the quantity of any good reserved by a single household during a busy week, so that more neighbors can share the harvest. Any such limit will be explained when you place your order.

5. Prices and Payment

Prices for harvest goods are set by Budster Farm LLC and are shown at the farm gate, on order confirmations, or in the message we send when you reserve. Prices may change with the season, with input costs and with availability. The price confirmed for your order is the price that applies to that order.

Where payment is taken at the gate, we accept the methods posted at the stand. Where a season share requires a deposit or an upfront payment, the amount and the deadline will be explained before you commit. We do not store payment card numbers on this website.

We price for neighbors and we keep our records open. If you believe you were charged in error, contact us and we will review the order and correct any mistake.

6. Pickup, Delivery and Farm Gate Rules

Most orders are collected at our yard at 980 W 1000 S, Logan - 84321-5415, United States (US). We confirm a pickup window when your order is ready and hold cooler goods in insulated storage until you arrive. Please arrive within the agreed window so fresh goods do not wait longer than necessary.

When you visit the farm gate, please respect the working nature of the yard. Stay clear of operating machinery, keep children within sight, follow crew directions, and do not enter storage bins or the mill area. Our gate rules exist for the safety of every visitor and the protection of the food.

If you cannot collect an order in person, you may send someone on your behalf or arrange a delivery where we offer one. Title and risk in the goods pass to you when the goods are handed over or loaded at the gate.

7. Nature of Fresh Produce

Fresh produce is a living product. Size, color, sweetness and texture vary from week to week because they depend on sun, water and soil. A tomato picked ripe may bruise more easily than a grocery tomato, and an ear of sweet corn is at its best within a day of cutting. These are qualities of real food, not defects.

We grade honestly and we do not knowingly sell goods that are past their best. If an item does not meet the standard we described, contact us within a reasonable time and we will make it right with a replacement, a credit or a refund.

Please store fresh goods as advised at pickup. Produce, eggs and dairy should be refrigerated promptly, and stone-milled flour is best kept dark, dry and used within a few weeks for the fullest flavor.

8. Season Shares and Memberships

A season share, such as the Sweet Corn and Melon Share, gives a member a recurring allotment of harvest goods over a defined part of the season. Shares are limited and are offered on a first come basis. By joining a share you accept the rhythm, pickup location and duration described at the time of enrollment.

Because shares are planned on planted acreage, the exact weeks and quantities can shift with the weather. We will communicate changes by message and at the gate board. If a share cannot run at all, we will offer an alternative or a fair refund for the unfulfilled portion.

Shares are personal to the member and are not transferable for profit. A member may send someone to collect a weekly allotment, but shares may not be resold without our agreement.

9. Cancellations, Changes and Refunds

You may cancel or change an order before we begin harvesting for it. Contact us as early as you can by phone or email so we can adjust our picking plan. Once goods are harvested and packed for you, a cancellation may not be possible because the food is perishable and was grown specifically for your order.

If you are not satisfied with an order, contact us within a reasonable time and we will review it. Where we agree that a good did not meet our standard, we will offer a replacement, a credit toward a future order, or a refund for the affected goods. We aim to be fair rather than rigid, because a farm stand lives on trust.

Refunds are returned by the same method used for payment where practical. Deposits for season shares may be subject to the terms explained at enrollment.

10. Allergens and Food Safety

Our farm handles many kinds of food, including wheat and other grains, eggs and dairy goods, and produce grown near flowers and pollen. We cannot guarantee that any item is free from traces of an allergen. If you have a serious allergy, please ask us about a specific good before you buy and use your own judgment about what is safe for your household.

We follow careful practices when gathering eggs, handling dairy and milling grain, and we keep cooler goods cold from the yard to your hands. Even so, food safety also depends on what happens after pickup. Refrigerate promptly, cook where appropriate, and follow the storage advice we provide.

11. Acceptable Use of the Website

You agree to use the Budster Harvest website lawfully and respectfully. Do not attempt to disrupt the site, gain unauthorized access to any system, upload malicious code, scrape content at scale, or use our pages to harass or mislead others.

You may read, print and share our pages for personal and non-commercial purposes. You may not present our content as your own or use our name to suggest a partnership that does not exist. If you would like to reference our farm in a publication or event, contact us and we will usually be glad to help.

We may restrict or refuse access to our website or our farm stand for anyone who misuses them or puts other customers and our crew at risk.

12. Intellectual Property

The Budster Harvest name, the Budster Farm LLC name, our page text, our visual design and the grain elevator motif that shapes our layout are owned by Budster Farm LLC or used with permission. They are protected by copyright, trademark and other laws.

You may not copy, reproduce, republish or distribute our content for commercial purposes without our written permission. Limited quoting for review, news or educational purposes is welcome when you credit Budster Farm LLC and link back to our website.

All rights not expressly granted in these terms are reserved by Budster Farm LLC.

13. Feedback and Submissions

We welcome your feedback about our harvest goods, our website and our farm gate. When you send us a suggestion, a review or a photograph, you grant Budster Farm LLC permission to use it to improve our farm stand and to describe our goods, without payment to you, unless we agree otherwise in writing.

Please do not send us confidential information or material that belongs to someone else. By sending a submission you confirm that you have the right to share it and that it does not violate the rights of another person.

We are not obliged to use any submission, and we may edit it for length and clarity if we do.

14. Third Party Links and Services

Our website may link to other sites, such as a mapping service or a community market. Those links are provided for convenience. We do not control those sites and we are not responsible for their content, their goods or their privacy practices.

Where we use a service provider to help run the farm business, that provider acts on our instructions. We are not responsible for the independent acts of a third party that we do not control, though we choose our partners with care.

If a link on our site no longer works or leads somewhere unsuitable, tell us and we will review it.

15. Disclaimer of Warranties

Our website and its content are provided as they are and as they are available. While we work to keep our pages accurate and online, we do not promise that the site will always be uninterrupted, error free or free of harmful components.

Harvest goods are provided subject to the variability of nature. Except for the commitments we make in these terms and any rights you hold under applicable law, we make no additional warranties about the goods, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Nothing in these terms limits any warranty or right that the law does not allow us to exclude, including rights you may hold as a consumer in your jurisdiction.

16. Limitation of Liability

To the fullest extent allowed by law, Budster Farm LLC will not be liable for indirect, incidental, special or consequential losses arising from your use of our website or from a purchase of harvest goods, including lost profits or lost opportunity.

Where liability cannot be excluded, our total liability for any claim relating to an order is limited to the amount you paid for the goods that gave rise to the claim. This limit does not apply to liability that the law does not allow us to limit, such as liability for fraud or for injury caused by our proven negligence.

We provide our goods for personal and household use. If you use them for a commercial purpose, you accept that we have not tailored our terms to that use.

17. Indemnity

You agree to hold harmless Budster Farm LLC, its owners, family members and crew from claims, losses and reasonable costs that arise from your misuse of our website, your breach of these terms, or your violation of the rights of another person.

This obligation does not apply to the extent that a claim results from our own conduct. We will let you know about any claim that involves you and will work with you in good faith to resolve it.

Because our farm stand serves the community, we ask that disagreements be handled respectfully and directly before they grow.

18. Events Beyond Our Control

We are not responsible for a delay or a failure to provide goods caused by events beyond our reasonable control. These events include severe weather, drought, frost, flood, fire, pest damage, crop failure, labor shortage, illness, supply disruption, utility failure and government action.

If such an event affects your order, we will contact you as soon as we can, explain what happened, and offer a reasonable alternative, a credit or a refund for goods we cannot provide.

A farm lives with the weather every day, and we appreciate the patience of neighbors who understand that the harvest sets the schedule.

19. Governing Law and Disputes

These terms are governed by the laws of the State of Utah and the United States, without regard to conflict of law rules. Subject to any mandatory consumer protections in your jurisdiction, the courts of Utah will have jurisdiction over any dispute that cannot be resolved informally.

Before starting formal proceedings, please contact us at reception@budsterharvest.lat or +15679077443 so we can try to resolve the matter directly. Most concerns are solved with a short conversation and a fair remedy.

If a dispute does proceed, both sides agree to act in good faith and to keep the process proportionate to the modest scale of our family farm business.

20. Changes to These Terms

We may update these Terms of Service as our farm stand changes or as the law requires. When we make a material change, we will revise the effective date at the top of this page and, where appropriate, post a notice on the website or tell customers who have asked to hear from us.

The version published on this page is always the current version. Continuing to use our website or to purchase harvest goods after a change means you accept the revised terms.

If you disagree with a change, you may contact us to discuss it and you may choose to stop using our website and services.

21. Severability and Entire Agreement

If any part of these terms is found to be unenforceable, the remaining parts stay in force, and the unenforceable part will be adjusted to the smallest extent needed to make it valid. These terms, together with our Privacy Policy and any order confirmation, form the entire agreement between you and Budster Farm LLC about our website and our harvest goods.

A failure by either side to enforce a term on one occasion does not waive that term on a later occasion. Headings are provided for readability and do not change the meaning of the sections they describe.

Where these terms conflict with a specific written arrangement we make with you, the specific arrangement controls for that order.
